JAMES DOBBIN McKAIN (1822-1847)

LAST WILL AND TESTAMENT

In the Name of God the Father, God the Son and God the Holy Ghost.

I James Dobbin McKain, Gentleman, late of Woolwich, Kent, England and now of Bordeaux in the Kingdom of France, being sound in mind though weak in body and mindful of my mortality, do this tenth day of November in the year of our Lord one thousand eight hundred and forty six make and publish my last will and testament.

1. By my father's will dated 23rd March 1846, I was named his Executor and guardian of my brothers and sisters. By the present I wish to confirm a successor's powers and say,

I maintain the whole of the first article of my father's will and testament, observing however that the there said first sum of one thousand one hundred and fifty pounds arising from an assurance in the Society of Equitable Assurances was placed by my care in the secure funds as will prove the deed in the drawer of my desk

3. I do will, give and bequeath for the benefit and use of his brothers and sisters Minors and I do bequeath in virtue of my power given me by my dear father's will dated 23rd March 1846 unto my brother William Fergus McKain, his heirs, executors, administrators and assigns all and every, my plate, furniture and whatsoever which shall be in my dwelling house except what for my father may have disposed of differently and further desire that my brother should find lodgings for his brothers and sisters as does say the enclosed will

4. I do maintain in their plenitude the articles of said will of our dear father's 4.5.6.7.8.9.10.11.12.13.14

5. I do name my aforesaid brother William Fergus McKain sole Executor of my Last Will & Testament and I also transmit him the Guardianship of his brothers & sisters Minors.

6. Should my brother Fergus McKain be absent at the time of my death and the coming into need of this, I desire with all my heart and steadfastly hope that one of my good agents Messrs. Stilwell would stand my brother's place until his return. I hereby revoke all or other wills heretofore made. In witness whereof I have to this my Last Will & Testament set & subscribed my hand & seal the day & year above written. James D. Mckain

Signed, sealed, published and declared before the said Testator James Dobbin McKain as and for his last Will and Testament in the presence of us who at his request and in the presence of each other have hereunto subscribed our names as witnesses thereto.
